Garda Data Access Request

Rights of Access

Data Protection Acts 2018 states -

Sec. 41. “Without prejudice to the processing of personal data for a purpose other than the purpose for which the data has been collected which is lawful under the Data Protection Regulation, the processing of personal data and special categories of personal data for a purpose other than the purpose for which the data has been collected shall be lawful to the extent that such processing is necessary and proportionate for the purposes -
(a) of preventing a threat to national security, defence or public safety
(b) of preventing, detecting, investigating or prosecuting criminal offences, or
(c) set out in paragraph (a) or (b) of section 47.”

Sec. 70 (1). “This Part applies, subject to subsection (2), to the processing of personal data by or on behalf of a controller where the processing is carried out
(a) for the purposes of—
(i) the prevention, investigation, detection or prosecution of criminal offences, including the safeguarding against, and the prevention of, threats to public security, or
(ii) the execution of criminal penalties,
and
(b) by means that;
(i) are wholly or partly automated, or
(ii) where the personal data form part of, or are intended to form part of, a relevant filing system, are not automated.

How can a member of An Garda Síochána make a Data Access Request?

This form must be completed and signed by a member of An Garda Síochána requesting copies of CCTV footage or other information relating to students/staff in relation to a specific criminal investigation.

Please return the completed Access Request by member of An Garda Síochána Form to the Data Protection Office by email to:

Please provide a full description of the information you are requesting.  Please provide as much information as possible to help the University locate the information such as the time periods concerned, names of data subjects or incidents. Please note we may have to get back to you to seek further clarification if we do not have enough detail to enable us to find the information you are seeking.

Right of Appeal

If the University fails to comply with a valid Subject Access Request or if you are not satisfied with our handling of your request, you can make a complaint to the Data Protection Commissioner:
