The aims of this module are to introduce the student to the legal system and to give the student a knowledge and understanding of contract law and selected areas of tort and employment law relevant to business. This knowledge and understanding will enable the student to limit the legal exposure of the business and liaise effectively with legal advisers. As law is an ongoing and dynamic subject the syllabus content will be expanded or modified, as the case may be, to reflect developments in the law set out in this module.
Introduction to the legal system
The distinction between civil and criminal wrongs. Sources of law: EU Law, the Constitution, legislation, caselaw. The doctrine of precedent. EU Institutions. The role of the European Court of Human Rights. The Courts. Legal personnel. Legal personality. Law reform. Finding the law: libraries, computer databases, internet.
Introduction to Tort
The nature of torts. Defences in torts. Negligence, including professional negligence. Occupier’s liability. Vicarious liability. Remedies.
Introduction to Contract
Formation of contract: offer, acceptance, consideration, intention to create legal relations, capacity to contract, formalities. Defects in contract: mistake, misrepresentation, duress and undue influence. Remedies.
Introduction to Employment Law
Distinction between a contract of service and contract for services. Unfair dismissal. Equality. Part-time and fixed term worker protection. Health and Safety.
