Module Overview

Employment Law

The module provides the student with a comprehensive understanding of Irish employment legislation. This understanding will equip the student with the skills necessary to apply the relevant legal principles in a business environment and the ability to recognize when to seek professional legal advice. As the employment relationship is an ongoing and dynamic one the syllabus content will be expanded or modified as the case may be to reflect developments in Employment Law.

The Employment Relationship

Contract of Employment. Contracts of service/for service. Express terms. Implied terms-Statute and Common law.Drafting employment contracts. Restrictive covenants Confidentiality. Data Protection. Protected Disclosures. Role of WRC. The Regulatory Fora. The role of the European Union in the employment relationship. Awareness of the application of the rules of contract to international employment contracts.

Employee Rights

Part time, fixed term, young persons, holiday entitlements and working time, payment of wages, minimum wage, maternity leave, adoptive leave, parental leave, carer’s leave.

Employment Equality Law

Discrimination. harassment, sexual harassment, equal pay, victimization. Remedies

Health and Safety

Common law and statutory duties of employers and employeees

Industrial Relations and Trade Unions

Freedom of Association, Industrial Relations Legislation. Trade unions

Termination of the Employment Contract

Statutory Protection, Minimum Notice, Lawful dismissal, Unfair dismissal, Wrongful dismissal,Disciplinary procedures. Redundancy. Transfer of Undertakings.
