This module builds on the previous legal module. The transport industry like all industries today is a complex industry. It is important the people operating in industry understand the implications of business law. It is not intended to turn the student in to a practitioner of the law. The area covered include Agency, Hire purchase and leasing, Employment law, Health and safety, Tort

Agency:

Definition of agency, types of agent, creation of agency, duties of principle and agent,

Termination of agency

 

Hire-purchase and leasing:

Consumer Credit Act, HP Acts, statutory requirement of HP agreements, implied terms, termination of agreement,

Recovery of goods, recovery of a motor vehicle, types of leases, duty of the hirer, leasing of goods,

 

Employment Law

Contract of employment, terms of employment, Dismissal fair and unfair. Redundancy,  Trade union Act, Bullying, Grievance procedures, Role of codes of practice, Organization of working time Act, Maternity protection Act , Employment equality Act .

Health and Safety.  Safety, Health and Welfare at Work (General Applications) Regulations 2007 (S.I. 299 0F 2007).  Duties of employers and employees, Safety statements, Enforcement of Act, Duties and   powers of inspectors, Prohibition and improvement notices, Appeals to courts, handling of hazardous goods, Role and duties of safety officers

Tort

This module will consist of formal classroom lectures and discussion. Case studies will be used to illustrate the various topics covered in lectures. Self-directed learning by the student will also further enhance the learning process
