Hospitality and Tourism Law

The aims of this module are to introduce the student to the legal system and to give the student a knowledge and understanding of selected areas of law relevant to a business in the hospitality and tourism industry. This knowledge and understanding will give the student an appreciation of how the legal system works, enable the student to limit the legal exposure of the business and liaise effectively with legal advisers.As law is an ongoing and dynamic subject the syllabus content will be expanded or modified, as the case may be, to reflect developments in the law set out in this Module.

The Legal System

Sources of law. The Courts and legal personnel. Law reform. Alternative dispute resolution. Comparison of sole trader, partnership and company as a means of carrying on business.

Law of Torts

Negligence. Liability for defective products. Passing off. Employers' liability. Occupiers' liability.

Employment Law

Contracts of service and contracts for services. Equality. Unfair dismissal. Health and Safety.

Commercial Law

Formation of Contracts. Sale of goods and supply of services. Unfair commercial practices. Unfair Terms. Data Protection. Discrimination in relation to the supply of goods or services.

Hospitality and Tourism Law

Types of licenses and renewal, offences, endorsement and forfeiture of licenses, closure orders, underage, conduct on licensed premises.Regulation of package holiday contracts. Duties and liabilities of hotel proprietors. Functions of the Food Safety Authority of Ireland.
