Module Overview

Construction Law

In this module the class participant, who is being prepared for an active and technical role in the construction industry, is introduced to the critical elements business law, to the Irish legal system and principles of the general law of contract. In the later part of the module the student, who has already become familiar with the concept of freely accepted legal obligation, i.e. contractual liability, is introduced to the idea of tortuous liability - legal liability which is normally imposed upon persons by the general law irrespective of their wishes.

The aim of this module is to give students an understanding of the nature and development of Irish law and its function in professional, construction, and commercial life. In addition, it is aimed to develop an understanding amongst students of the relevance of Irish law and of European law in their lives. It is aimed to introduce students to the nature and development of Irish law and to teach the essentials of contractual liability. It is essential that persons involved in the construction industry and actively engaged in carrying out of building contracts should realise that in this industry the fulfilment of contractual obligation is not sufficient: the modern-day construction professional must also be aware of those wider legal obligations that affect almost every aspect of the building process.
