Module Overview

Employment Law

The aim of the course is to provide the student with an overview of the laws and regulations that apply to employment relationship in an Irish workplace. The programme examines the duties of both employees and employers and provides students with a broad understanding of employment law issues through the analysis of existing legislation and case law.

On successful completion of this programme all participants will have studies the main sources of employment law including the concept of "employee", the design of an employment contract, equality issues including bullying in the workplace, holidays and leave entitlements, termination of contracts and redundancy issues, health and safety concerns, and privacy in the workplace

  2. Statutory implied terms – Organisation of Working Time Act 1997– Payment of Wages Act 1991-Terms of employment Information Act 1973
  1.  Family Leave: Maternity, Adoptive, Parental and Paternity leave entitlements
  1.  Atypical Employment: elimination of discrimination and prevention of abuse
    (i) Part-Time work
    (ii) Fixed-Term work

  1. Equality at Work – Discriminatory grounds. Direct and Indirect Discrimination. Burden of Proof. Harassment. Adverse treatment. Redress
  1. Termination of Employment – Fair and Unfair dismissal -constructive dismissal, Redress. Redundancy

As for full time programme

The module combines formal lectures, problem based learning, task based learning activities, group work, case studies, to create a ‘student-centric’ learning experience. In addition, video presentations, guest speakers and contributors to the Irish Employment sector will be reviewed to illustrate key themes in the module. 

 The module will be delivered over 24 weeks (48 hours) and will require an additional 152-hour self-directed learning encompassing pre class readings, group based activities, module assignment and exam preparation.
