Module Description
This module is designed to introduce students to the Irish and European legal system, and to
Irish and European Law as they both relate to Business; and in particular to the fundamental
legal principles of Business Law that are relevant to Retail and Services Management.
Module Aim
The aim of this module is to equip students with a knowledge and understanding of the legal
principles generally applicable to the study of Business Law, to provide a comprehensive
foundation of relevant legal knowledge and to help the student to develop deductive and
analytical skills.
This module sets out to convey an understanding of the legal principles and practices
which underpin and regulate business in Ireland.
The course objective is to provide students with a broad knowledge of the principles of
Irish law as it affects commercial transactions.
In addition, students are required to familiarize themselves with the relevant regulatory
Authorities and examine their regulatory remit and online presence as a learning source.
The module focuses on key legal issues relevant to the retail sector with a specific
emphasis on contract law, consumer rights and regulations, and employment law.
The module starts with an examination of the general legal environment in which
businesses operate, and then proceeds to look at the essentials of establishing and
performing simple contracts, disputes between contractual parties, court actions and
available remedies in the event of a breach.
In addition, an examination the sale of goods contract is undertaken, including an
analysis of the terms of a consumer- retailer contract from the perspective of both the
retailer and consumer.
Finally, students will also be introduced to basic employment and insurance law
principles with reference to recent initiatives in the legislative and regulatory
framework.
Business and Consumer Law content
An examination of the key principles and sources of Irish law, court structures and aspects of ADR. Understanding how a bill becomes a law; the separation of powers; government, legislature and judiciary. An in depth analysis of the substantive laws of contract, consumer, company law within an Irish and European context. An examination of Irish and European competition law, particularly those aspects which are pertinent to the retailer, and generally the role of the CCPC. An examination of the contract of employment, its special features and legislative framework which underpins may of contractual terms. Understanding the basic principles of unfair dismissal, constructive dismissal, and redundancy, and the role of the Workplace Relation Commission. Examination of the essential features of the specific contract for sale of goods and the supply of services, the relevant legislative framework. In addition, specific consumer law topics (e.g. buying online) will be examined Examination of the formalities required by law, an examination and analysis of the simple contract, the standard business contract, disputes between contractual parties, court actions and available remedies. Examination of the employment contract including the typical issues that arise with the employer-employee relationship. AN overview of Key areas such as terms and conditions of employment; working hours, breaks, annual leave, dismissal, redundancy will also be examined.
Learning and teaching will take place through the use of lectures, case studies, class discussions, presentations and problem solving exercises in the module.
In addition to using text based material, students will be expected to make extensive use of relevant websites, external online audio and video resources referred throughout the course.
